VAT Fraud

ALTEXIS participated on January 23rd, 2009 to a Fiscalis seminar in Amsterdam initiated by the Dutch Tax Authorities in cooperation with the European Commission to exchange ideas with representatives from businesses, national tax administrations and European Commission in connection with the Commission’s Communication on a coordinated strategy to improve the fight against VAT fraud within the EU, adopted on December 1st, 2008.

The seminar was organized through three workshops: the short term action plan set out in the Commission Communication, a long term approach based on possibilities offered by digital solutions, compliance strategies and sharing of information between the different Member States in order to fight VAT fraud.

ALTEXIS contributed to the first workshop which comments Commission’s proposals set out in the short term action plan aiming at preventing VAT fraud, detection of VAT fraud and improving the possibilities for the collection of tax foregone by fraud.

For example, improvement of common minimum standards for all Member States for the registration and deregistration of taxable persons would be an effective mean in prevention of VAT fraud. This should allow taxable persons to verify the validity of their suppliers/customers’VAT number on the basis of reliable and standardized information within the VIES system.

Directive 2008/117/EC of 16 December 2008 amending the Directive 2006/112/CE and Regulation (EC) No. 37/2009 of 16 December 2008 which amends Regulation No. 1798/2003 published in the Official Journal of January 20th, 2009 already contain provisions to combat tax evasion connected with intra-Community transactions, in particular reduction and harmonisation of timeframes for filing VAT returns and recapitulative statements relating to intra-Community supplies of goods.
